TERMS AND CONDITIONS:

  1. All sales are final, and no returns are accepted. Kittens are sold as-is. The buyer acknowledges and agrees that there are no refunds or returns. The kitten is guaranteed to be in good health and free from any diseases at the time of sale, to the best of the seller/veterinarian's knowledge.

  2. The buyer confirms that they will provide a safe and suitable home for the purchased kitten.

     

SHIPPING DUTY/ OBLIGATIONS:

  1. Once the kitten is ready for travel, it will typically ship within 10-20 days from the purchase date. The final delivery date will be determined by the seller, in consultation with a veterinarian. Delivery is facilitated through third parties such as freight brokers, state veterinarians, and airlines.

  2. The seller is not liable for any delays in shipping due to reasons including but not limited to weather conditions, logistical issues, transport failures, or unforeseen events. The buyer acknowledges that flight delays, airport delays, or cancellations are non-refundable. The seller is only responsible for providing necessary health certificates and vaccine records for domestic flights within the USA and Canada.



HEALTH GUARANTEE:

  1. The seller guarantees that all kittens are litter box trained and have begun training on a scratching post. Additionally, the seller guarantees that the pet is free of FeLV (feline leukemia) and FIV (feline AIDS). The pet will have been examined by a veterinarian and received all age-appropriate vaccinations at the time of pick-up.

  2. The buyer may request additional disease screening and vaccines at their own discretion and cost.

  3. The seller does not guarantee the pet against respiratory diseases, fleas, ringworms, or any nuisance diseases, except for congenital disabilities after the kitten arrives at its new home.

  4. Failure by the buyer to have the pet examined by a veterinarian within the first five days of receiving the kitten, or evidence of abuse, neglect, or mishandling, releases the seller from any responsibility regarding the pet.

  5. The seller provides a 6-week coverage from the delivery date against death due to FIP (feline infectious peritonitis), confirmed by a licensed veterinarian through necropsy. In the next 6 months, the buyer is entitled to a 50% store credit if the kitten passes away due to FIP.

  6. In the event of the pet's death within one year of the delivery date due to a hereditary or congenital defect, certified by a necropsy from a licensed pathologist, the seller will replace the pet. The buyer must present certified proof of the defect within 30 days of the necropsy being performed.

  7. The seller is not obligated to replace the pet with the exact color/pattern/sex, but reasonable attempts will be made.



SELLER'S DUTY/ OBLIGATIONS:

  1. The seller guarantees the quality of the pet as specified in the contract. The pet will be transferred to the buyer at a minimum age of three months, with preventive vaccinations, deworming, and appropriate veterinary records.

  2. The seller does not guarantee the pet's performance, contest wins, or title awards.

     

BUYER’S DUTY/ OBLIGATIONS:

  1. The buyer shall provide proper care, nutrition, timely veterinary care, and vaccinations for the pet. Copies of all medical records must be kept, and in case of a claim for replacement, copies must be provided to the seller.

  2. The buyer must take the pet for a veterinary exam within 5 days of the delivery date, failing which, all guarantees shall be voided.

  3. The buyer agrees not to declaw the pet, as it may cause permanent damage, releasing the seller from any responsibility.

  4. The buyer shall not transfer the pet to a shelter or research center without written consent from the seller. If consent is given, the buyer must provide proof of spaying or neutering.



BREEDING RIGHTS:

  1. If the pet was purchased without breeding rights, the buyer must have the pet spayed or neutered by the age of eight months. Failure to comply will constitute a material breach of the agreement.

  2. Liquidated damages may apply in case of breach of the breeding rights agreement.



RETURN / REFUND:

  1. In case the pet is found unhealthy upon acquisition, confirmed by a licensed veterinary clinic, the seller will accept the return and issue a store credit.

  2. The buyer has no right to demand a refund or compensation for dissatisfaction with the pet unless it is found to be unhealthy at the time of acquisition.

  3. The seller reserves the right of first refusal if the buyer is unable to care for the pet, and the pet must be returned to the seller if necessary.



VETERINARY PASSPORT & EXCEPTIONS:

  1. The seller does not guarantee the pet's personality, confirmation, size, weight, color, markings, or breeding ability.

  2. Heart murmurs in grades 1 or 2 and certain other conditions are not covered under the guarantee.

  3. Failure to provide proof of timely veterinary care and vaccinations will void the guarantee.

  4. The buyer agrees not to vaccinate the pet for feline infectious peritonitis (FIP) and not to declaw the pet.

  5. Breeding rights come with certain conditions and restrictions as outlined in the agreement.
